Appointing Your Chief AI Officer: What the Role Actually Requires in an APS Agency
The APS AI Plan is clear on one thing: every non-corporate Commonwealth entity must have a Chief AI Officer in place by July 2026. What it doesn’t tell you is how to actually stand the role up in a way that works.
That gap is where agencies are going to struggle.
Most will default to the path of least resistance — attach the CAIO label to an existing SES, write a brief terms of reference, point to it in the next capability uplift report, and move on. That produces a compliance figurehead, not a governance function. And when something goes wrong with an AI system — a biased recommendation, a procurement that bypasses proper oversight, a model that drifts after deployment — the figurehead won’t save you.

The Three-Role Problem Nobody Wants to Talk About
The APS policy framework now asks agencies to operate with three distinct AI-related accountability roles: the AI Accountable Official, the Chief AI Officer, and in many agencies, an existing Chief Data Officer. These roles have overlapping interests and, if you’re not deliberate, overlapping authority.
The AI Accountable Official sits at the highest level — typically a Deputy Secretary or equivalent — and holds ultimate responsibility for how AI is used responsibly across the agency. The CAIO is meant to operationalise that accountability. The CDO, where one exists, already owns data strategy, data governance, and increasingly the infrastructure that AI systems depend on.
If you don’t define the boundaries between these three roles explicitly, you get one of two failure modes:
Failure mode one: The CAIO defers everything upward to the Accountable Official and sideways to the CDO. They have no real decision rights. They attend committees, they review documents, they provide advice — but nothing requires their sign-off. This is the figurehead outcome.
Failure mode two: The CAIO and CDO compete over AI. Conflict over who owns the data pipeline for an AI system, who approves a new use case, who reports to the Secretary. Turf wars slow everything down and confuse delivery teams who need a clear answer.
Neither outcome serves your agency or the public.

Where the CAIO Should Sit
The CAIO needs to sit close enough to the Accountable Official to carry real authority, but with sufficient operational independence to engage directly with delivery.
In practice, this means the CAIO should report directly to the Accountable Official — not through the CDO, not through a CIO. If the CAIO reports through another SES, their effective authority is bounded by that SES’s priorities. AI governance doesn’t work that way. You need someone who can walk into a conversation about a high-risk AI deployment and have the organisational weight to stop it, escalate it, or approve it without having to check with three other people first.
That said, this doesn’t mean the CAIO operates in isolation. The relationship with the CDO needs to be tightly defined by design — not left to the individuals to sort out. A workable split: the CDO owns data governance, data quality, and infrastructure; the CAIO owns AI use-case governance, risk assessment for AI systems, and the agency’s AI assurance framework. Where an AI system depends on data infrastructure, the two roles co-sign. Write that down. Put it in governance documents. Make it real.

Decision Rights: The Thing That Makes or Breaks the Role
The CAIO’s effectiveness lives or dies on what they can actually decide — not advise on, not review, not provide input into. Decide.
Here is a minimum viable set of CAIO decision rights for an APS agency:
Mandatory. The CAIO must approve any AI use case before deployment into a production environment. This isn’t a recommendation to the Accountable Official — it’s a sign-off gate. No CAIO approval, no deployment. Agencies that skip this step are running AI risk through program teams who don’t have the frameworks to assess it properly.
Escalation authority. The CAIO must have the standing to pause or suspend an AI system that presents unacceptable risk — pending review, remediation, or decommission. This power needs to be explicit in the governance framework, not implied.
Assurance framework ownership. The CAIO sets the agency’s AI assurance requirements — what testing, what explainability standards, what monitoring cadence applies to different risk tiers of AI systems. The CDO implements infrastructure to support those requirements. Other SES execute against them. The CAIO doesn’t run assessments themselves, but they set the standard.
Incident reporting. AI-related incidents — model failures, unintended outputs, compliance breaches — land with the CAIO first. They triage, escalate to the Accountable Official where warranted, and own the remediation process.
Without these four things, the CAIO is an observer with a title.

Embedding the CAIO Without Creating Another Committee
The default response to any new governance role in APS is to build a committee around it. You’ll be tempted to establish an AI Governance Committee that the CAIO chairs, sitting alongside the Data Governance Committee, the Digital Committee, and whatever other forums already exist. Resist this.
You don’t need a new committee. You need the CAIO embedded into the forums that already hold real authority.
The right move is to give the CAIO a formal standing in your agency’s existing investment and assurance committees. Any project or program that involves AI — whether that’s procurement of a vendor AI product, development of an in-house model, or integration of an AI capability into an existing service — should require a CAIO assessment as part of the business case gate. Not a note from the program team that says they’ve considered AI risk. An actual CAIO assessment.
This means the CAIO needs to be resourced. Not just a named person — a small team. The role cannot function as a second hat for an already stretched SES. You need analytical capability sitting under the CAIO who can work with delivery teams on risk assessments, review technical documentation, and maintain a live register of AI systems in use across the agency.
If your agency is small and that resourcing is difficult, that’s a conversation to have with Finance or APSC about shared models. Some smaller entities may be able to operate with a shared CAIO function across a cluster. But that model requires its own governance design — particularly around conflict of interest when one agency’s use case creates risk for another’s functions.

The Skills Profile: Stop Hiring the Wrong Person
The CAIO role is not a rebranded data scientist position. It’s also not a rebranded policy role.
You need someone who can read a model card and understand what it means for downstream risk. Someone who can engage credibly with vendors selling AI platforms without being captured by the sales pitch. Someone who understands the Automated Decision-Making requirements under the Privacy Act, the implications of the APS AI Ethics Principles, and how these interact with the agency’s own legislative framework.
At the same time, they need to be able to operate at SES level — navigate budget processes, brief ministers and Secretaries, engage with ANAO on audit, and make governance decisions under ambiguity.
This profile is rare. If you’re appointing from within, invest in their technical upskilling before the role goes live. If you’re recruiting externally, don’t let the selection panel treat AI literacy as a nice-to-have. It’s the core requirement.

The July 2026 Deadline Is Closer Than It Looks
Agencies that leave this until mid-2026 will be scrambling — rushing an appointment, skipping the structural design work, and producing exactly the compliance figurehead the policy is trying to move beyond.
The structural questions — where the CAIO sits, how authority is divided with the CDO and Accountable Official, what decision rights are explicit, how the role is resourced — take months to work through properly. You need to start now.
Get the governance design right before you fill the seat. A poorly designed CAIO role with the wrong person in it is worse than no CAIO at all, because it creates the appearance of oversight without the substance.
